Supercar Mindset

These Terms and Conditions (“Agreement”) constitute a legally binding contract between you (“Member,” “you,” or “user”) and Supercar Mindset, LLC (“Supercar Mindset,” “we,” “us,” or “our”), governing your access to and use of our website, membership program, events, and related services (collectively, the “Services”).
BY ACCESSING OR USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY CEASE ALL USE OF THE SERVICES.
To become a Member and participate in Supercar Mindset events:
You must be at least 18 years of age.
You agree to provide truthful, accurate, and complete information during registration.
Membership is subject to approval and is non-transferable.
You agree to comply with all applicable laws, regulations, and club rules.
Supercar Mindset reserves the sole and exclusive right to accept, reject, suspend, or terminate membership at any time, for any reason, with or without notice.
By purchasing a membership:
You agree to pay all fees as listed at the time of enrollment.
You authorize Supercar Mindset to charge your designated payment method on a recurring basis unless you cancel.
All payments are non-refundable, non-transferable, and final, unless otherwise expressly stated in writing.
Failure to remit payment may result in immediate suspension or termination of Services.
We reserve the right to adjust pricing, with at least 15 days’ written notice via email or our website.
By using our Services, you agree that you will NOT:
Use the Services for unlawful, harmful, abusive, or disruptive purposes.
Impersonate any person or entity, or falsely state your affiliation.
Infringe upon any intellectual property or proprietary rights.
Harass, threaten, or harm other members, staff, or law enforcement.
Violation of this section may result in immediate revocation of membership without refund, and potential legal action.
All content, designs, trademarks, logos, and proprietary materials on our website or presented during events are the exclusive property of Supercar Mindset or its licensors.
You may not copy, reproduce, distribute, display, or create derivative works from any content without prior written consent.
Unauthorized use constitutes a material breach of this Agreement and may result in legal action.
Participation in Supercar Mindset activities involves inherent risks, including high-performance driving, police-escorted events, and third-party interactions. By using the Services, you voluntarily assume all such risks.
To the maximum extent permitted by law, Supercar Mindset shall not be liable for:
Any direct, indirect, incidental, or consequential damages.
Personal injury, property damage, or death.
Loss of profits, revenue, data, or reputation.
System failures, delays, or unauthorized access.
Your exclusive remedy for dissatisfaction is to stop using our Services.
You agree to indemnify, defend, and hold harmless Supercar Mindset, its affiliates, directors, officers, staff, and agents from and against any claims, damages, liabilities, losses, and expenses (including attorneys’ fees) arising out of:
Your use or misuse of the Services.
Your violation of this Agreement or any applicable laws.
Any claim or demand made by a third party due to your conduct.
Supercar Mindset reserves the right to terminate, suspend, or refuse service to any Member:
Who violates these Terms;
Whose conduct is deemed unsafe, disruptive, or harmful;
Who fails to remit payment when due.
Termination does not release you from financial obligations incurred prior to termination. No refunds will be issued upon termination.
This Agreement shall be governed exclusively by the laws of the State of Florida, without regard to conflict-of-law principles.
All disputes shall be resolved exclusively by binding arbitration under the rules of the American Arbitration Association (“AAA”), held in Orlando, Florida, before a single arbitrator. You and Supercar Mindset waive any right to a trial by jury or to participate in a class action.
Supercar Mindset reserves the right to modify, relocate, or amend these Terms and Conditions and any related policies at any time. This includes, but is not limited to:
Changes resulting from a website redesign, content migration, or reorganization;
Moving this Agreement or associated policies to another page or platform.
Such modifications shall remain legally valid and enforceable, and do not constitute a termination or waiver of any provisions herein. Continued use of the Services constitutes your acceptance of the current version of these Terms, regardless of where hosted.
